These Terms & Conditions govern the purchase and use of travel-planning services provided by Kelvin Amarelle, trading as Amarelle Atlas ("Amarelle Atlas", "we", "us" or "our").

By purchasing or using an Amarelle Atlas service, you agree to these Terms & Conditions.

Please read them carefully before placing an order.

1. About Amarelle Atlas

Amarelle Atlas is a personalised travel-planning service operated by Kelvin Amarelle as a sole trader.

Our services involve researching and preparing personalised travel plans, recommendations and itineraries based on information and preferences provided by the customer.

Amarelle Atlas does not act as your airline, hotel, tour operator, transport provider, restaurant, attraction or other travel-service provider.

Unless expressly stated otherwise, we do not make bookings on your behalf.

2. Our Travel-Planning Services

Amarelle Atlas provides personalised travel-planning services designed to help customers research, organise and plan their trips.

Depending on the package purchased, your travel plan may include recommendations or information relating to:

  • Destinations

  • Accommodation

  • Restaurants

  • Attractions

  • Activities

  • Transport

  • Areas and neighbourhoods

  • Suggested routes

  • Day-by-day itineraries

  • Travel tips

  • Other travel-related recommendations

The exact services included in your purchase will depend on the package selected at the time of purchase.

We will make reasonable efforts to provide a travel plan that reflects the requirements and preferences you provide to us.

3. We Do Not Make Travel Bookings

Unless expressly agreed otherwise in writing, Amarelle Atlas does not book travel services on your behalf.

You remain responsible for making and paying for your own:

  • Flights

  • Accommodation

  • Restaurants

  • Activities

  • Tours

  • Transport

  • Tickets

  • Travel insurance

  • Other travel arrangements

Any links, recommendations or references to third-party travel providers are provided to assist your planning.

When you make a booking with a third-party provider, you enter into a separate agreement with that provider and are subject to that provider's own terms, conditions, cancellation policies and fees.

Amarelle Atlas is not responsible for the performance, availability, cancellation, alteration, pricing, quality or failure of any third-party travel provider.

4. Placing an Order

When you purchase an Amarelle Atlas package, you are making a request to purchase the selected travel-planning service.

Your order will be accepted when payment has been successfully processed and we confirm the order.

The contract between you and Amarelle Atlas consists of:

  • The package and price selected at checkout

  • Any information provided to you before purchase

  • These Terms & Conditions

  • Any specific terms communicated to you as part of your purchase

You should review your order carefully before completing payment.

5. Pricing and Payment

The price of your selected package will be displayed before you complete your purchase.

Unless expressly stated otherwise, payment is required in full at the time of purchase.

Payment plans

Amarelle Atlas does not currently offer payment plans or instalment arrangements.

If payment plans are introduced in the future, separate terms may apply.

6. Starting Your Travel Plan

Amarelle Atlas may begin work on your travel plan after your purchase and once we have received the information reasonably required to begin planning.

When purchasing the service, you may expressly request that Amarelle Atlas begins work immediately, including before the expiry of any applicable statutory cancellation period.

By making this request, you acknowledge that work may begin before the applicable cancellation period has ended.

Where applicable law provides you with a statutory right to cancel during that period, that right will continue subject to the applicable law.

If you cancel after work has begun during an applicable cancellation period, you may be required to pay a proportionate amount for the service actually provided up to the time of cancellation, where permitted by law.

This reflects the value of the personalised planning work already completed.

Where applicable law permits a consumer to lose a cancellation right following full performance of a service, we will obtain any consent or acknowledgement required by that law.

Our commercial cancellation policy is as follows, subject always to any statutory rights you may have.

Before planning has started

If you cancel before Amarelle Atlas has begun work on your travel plan, you will generally receive a full refund.

After planning has started

If planning work has already begun, any refund will generally be calculated based on the proportion of the service that has not yet been completed.

The amount retained may reflect the reasonable value of work already completed.

This may include research, destination planning, itinerary development, recommendations and other personalised work carried out before cancellation.

Where a statutory cancellation right applies, any refund or payment due will be determined in accordance with the applicable law.

After the itinerary has been delivered

Once your completed travel itinerary has been delivered, we do not provide refunds simply because you have changed your mind or no longer wish to use the itinerary, subject to your statutory consumer rights.

This does not affect your rights where the service has not been provided as required by applicable consumer law.

8. Statutory Consumer Rights

Nothing in these Terms & Conditions is intended to exclude, restrict or override any consumer rights that cannot legally be excluded.

If applicable consumer law provides you with rights to a refund, cancellation, remedy, compensation or other protection, those rights continue to apply.

For customers in Australia, services supplied by businesses covered by the Australian Consumer Law are subject to mandatory consumer guarantees that cannot be removed by contractual terms.

For UK customers, applicable consumer legislation may provide a statutory cancellation period for distance contracts. Where a customer expressly requests that a service begins during that period, applicable law may permit the business to charge a proportionate amount for services supplied before cancellation.

Applicable US federal and state consumer protection laws may also provide rights that cannot be excluded by these Terms.

9. Revisions

The number of revisions included depends on the Amarelle Atlas package purchased.

Your package will specify whether it includes one or two revisions.

An included revision is intended for small, specific changes to recommendations within the destination or itinerary already planned.

Examples may include:

  • Replacing a particular restaurant

  • Changing a specific attraction

  • Substituting one activity

  • Requesting an alternative recommendation for a particular location

An included revision does not include substantial restructuring of the travel plan.

For example, revisions do not ordinarily include:

  • Replanning multiple days

  • Rebuilding an entire itinerary

  • Adding multiple new destinations

  • Changing the entire trip structure

  • Replanning a trip around substantially different requirements

  • Changing the dates of an entire trip where this requires substantial additional work

If you require substantial additional planning, we may offer this as an additional paid service.

Additional revisions beyond those included in your package may also be purchased separately.

10. Changes After Approval

Once you have approved your travel plan or itinerary, subsequent changes may incur an additional charge.

This includes changes that require Amarelle Atlas to carry out additional research or substantially amend previously completed work.

Any additional charge will be communicated to you before the additional work is undertaken.

11. Accuracy and Availability of Travel Information

We make reasonable efforts to ensure that information included in your travel plan is accurate at the time it is researched.

However, travel information can change.

This includes:

  • Opening hours

  • Prices

  • Availability

  • Restaurant menus

  • Transport schedules

  • Flight schedules

  • Attraction availability

  • Temporary closures

  • Local events

  • Entry requirements

  • Booking requirements

  • Third-party terms

  • Operating conditions

Accordingly, recommendations are provided based on information available to us when the travel plan is prepared.

We cannot guarantee that every recommendation will remain available, unchanged or suitable at the time you travel.

Where appropriate, you should independently verify important information before making a booking or travelling.

12. Customer Responsibilities

You are responsible for providing accurate and complete information needed to prepare your travel plan.

This may include:

  • Travel dates

  • Destinations

  • Preferences

  • Budget

  • Number of travellers

  • Relevant requirements

  • Other information reasonably necessary for planning

You are responsible for checking that the final itinerary meets your personal requirements before travelling.

You are also responsible for:

  • Ensuring that your passport and travel documents are valid

  • Checking visa and entry requirements

  • Checking immigration requirements

  • Obtaining appropriate travel insurance

  • Checking health and vaccination requirements

  • Checking airline, accommodation and transport requirements

  • Making your own bookings

  • Checking booking details before payment

  • Checking cancellation policies of third-party providers

  • Ensuring that you have sufficient funds and appropriate payment methods

  • Making your own final decisions regarding travel arrangements

Amarelle Atlas does not provide immigration, legal, medical or financial advice.

13. Third-Party Travel Providers

Amarelle Atlas may recommend third-party businesses, including:

  • Hotels

  • Airlines

  • Restaurants

  • Tour operators

  • Activity providers

  • Transport companies

  • Booking platforms

  • Attractions

These recommendations do not constitute an endorsement or guarantee of the third party's services.

Any agreement you enter into with a third-party provider is between you and that provider.

Amarelle Atlas is not responsible for:

  • Third-party cancellations

  • Changes to bookings

  • Price increases

  • Service quality

  • Overbooking

  • Closures

  • Delays

  • Refund policies

  • Availability

  • Injuries or losses arising from third-party services

  • Changes to third-party terms

You should review the relevant provider's own terms before making a booking.

14. Travel Disruptions

Travel can be affected by circumstances outside our control, including:

  • Weather

  • Natural disasters

  • Transport disruption

  • Strikes

  • Government restrictions

  • Border restrictions

  • Political or security events

  • Public health events

  • Airline or accommodation changes

  • Local closures

  • Other unforeseen circumstances

Amarelle Atlas cannot guarantee that your planned itinerary will be possible under all circumstances.

Where circumstances change before or during your trip, you remain responsible for making appropriate decisions regarding your travel arrangements.

15. No Guarantee of Particular Travel Outcome

Our service provides planning and recommendations.

We do not guarantee that using an Amarelle Atlas itinerary will result in a particular travel experience or outcome.

For example, we cannot guarantee:

  • Perfect weather

  • No travel delays

  • Restaurant availability

  • Attraction availability

  • Particular experiences

  • Particular views

  • Particular room types

  • Crowd levels

  • Transport availability

  • Third-party service quality

Our recommendations are intended to assist your planning and decision-making.

16. Intellectual Property

Unless otherwise stated, the travel plans, itineraries, written content, layouts, templates, recommendations and other materials created by Amarelle Atlas remain the intellectual property of Amarelle Atlas.

Your purchase grants you a personal, non-exclusive licence to use the travel plan for your own personal travel purposes.

You may:

  • View the itinerary

  • Save it for personal use

  • Print it

  • Share it with the people travelling with you

  • Use the recommendations when planning your trip

You may not, without our written permission:

  • Resell the itinerary

  • Repackage it as your own product

  • Use it commercially

  • Publish it as your own work

  • Reproduce it for commercial distribution

  • Use it to provide travel-planning services to other people

  • Copy substantial portions for another commercial product

17. Website Content

The content published on the Amarelle Atlas website is provided for general information about our services.

We make reasonable efforts to keep website information accurate and current but do not guarantee that all website content will always be complete, accurate or up to date.

We may update, change or remove website content at any time.

18. Website Links

Our website or travel plans may contain links to third-party websites.

These links are provided for convenience and information.

We do not control third-party websites and are not responsible for their:

  • Content

  • Availability

  • Security

  • Privacy practices

  • Terms

  • Pricing

  • Products or services

You should review the relevant third party's terms and policies before using their website or purchasing their services.

19. Liability

To the maximum extent permitted by applicable law, Amarelle Atlas will not be responsible for losses arising from:

  • Third-party travel services

  • Third-party bookings

  • Changes to travel arrangements

  • Travel delays or cancellations

  • Changes in prices or availability

  • Incorrect information supplied by the customer

  • Failure by the customer to check important travel information

  • Events outside our reasonable control

  • Decisions made by the customer based on travel recommendations

Nothing in these Terms limits or excludes liability where doing so would be unlawful.

Nothing in these Terms excludes or limits any consumer guarantee, statutory right or other protection that cannot legally be excluded.

20. Australian Consumer Law

For customers to whom the Australian Consumer Law applies:

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled:

  • to cancel your service contract with us; and

  • to a refund for the unused portion, or to compensation for its reduced value.

You are also entitled to be compensated for any other reasonably foreseeable loss or damage.

If the failure does not amount to a major failure, you are entitled to have problems with the service rectified in a reasonable time. If this is not done, you are entitled to cancel your service contract and obtain a refund of the unused portion.

This wording reflects the mandatory consumer guarantee wording specified by the ACCC for services.

21. UK Consumer Rights

For UK customers, applicable consumer legislation may provide rights relating to distance contracts, cancellation periods, services beginning during a cancellation period and proportionate payment for services supplied following an express request to begin early.

Nothing in these Terms is intended to remove or restrict those rights.

Where a customer requests that Amarelle Atlas begins work immediately, the customer may still have applicable statutory cancellation rights. Where permitted by law, Amarelle Atlas may retain or charge a proportionate amount reflecting the service actually provided before cancellation.

Where the service has been fully performed during an applicable cancellation period following the customer's required express request and acknowledgement, the applicable statutory cancellation right may cease where permitted by law.

22. US Customers

Customers in the United States may have rights under applicable federal and state consumer protection laws.

Nothing in these Terms is intended to waive or restrict rights that cannot legally be waived.

Refunds and cancellations for US customers will be handled in accordance with these Terms and any mandatory consumer protections applicable to the customer's transaction.

23. Events Outside Our Control

We will not be liable for a failure or delay in providing our services where the failure or delay results from circumstances outside our reasonable control.

This may include:

  • Internet or technology failures

  • Platform outages

  • Payment-provider failures

  • Natural disasters

  • Government actions

  • War or civil unrest

  • Strikes

  • Major transport disruption

  • Cybersecurity incidents

  • Widespread service outages

  • Other circumstances that could not reasonably have been prevented or anticipated

Where reasonably possible, we will communicate with you about significant delays affecting your service.

We may update these Terms & Conditions from time to time to reflect changes to:

  • Applicable laws

  • Our business practices

The version of the Terms applicable to your purchase will generally be the version in effect when you placed your order, unless a change is required by law or otherwise agreed with you.

The Last updated date at the beginning of these Terms will be updated whenever material changes are made.

27. Governing Law

These Terms are intended to operate in accordance with applicable laws.

Where permitted by applicable law, these Terms and your relationship with Amarelle Atlas will be governed by the laws of New South Wales, Australia.

Nothing in this section is intended to deprive a consumer of mandatory rights or protections available under the laws of their country, state or territory where those rights cannot legally be excluded.

28. Severability

If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be interpreted or modified to the minimum extent necessary to make it enforceable where possible.

The remaining provisions will continue to apply.

29. Entire Agreement

These Terms, together with the specific package information provided at the time of purchase and our Privacy Policy, form the agreement between you and Amarelle Atlas concerning the relevant travel-planning service, except where additional terms have been expressly agreed in writing.
